Term Main definition
Information

Trademark owners may request information from a trademark infringer, such as about the distribution channel or purchase prices (trademark infringement).

Trademark owners may assert various claims against infringers, including a claim for information. In this case, the infringer will need to provide information about the origin and the distribution channels of the unlawfully marked goods and services, i.e., names and address data of the manufacturer, the suppliers and other prior owners, the commercial customers or clients, and the quantities of the manufactured, delivered, or ordered goods.

The right to information is supposed to enable the infringed party to precisely quantify the claim for damages. In addition, the injured party may use the claim for information to enforce rights against suppliers and commercial customers and to remove the infringing products from distribution channels.
