The Trademark Office does not check whether similar or identical trademarks have already been registered. Therefore, prior to applying for a trademark, a search should be conducted to determine whether the planned trademark infringes upon earlier rights.

Search is an important step in planning and implementing your trademark strategy. Prior to using a sign to identify your company’s goods or services, you should clarify whether the sign has not already been registered for a third party and whether the sign does not infringe third-party IP rights.

A search for identical signs is included in our BASIS, ECO, and PRO packages. We also recommend a trademark similarity search, which is included in our PRO package because similar trademarks can also pose problems.
