Seniority

When applying for an EU Trade Mark, it is possible to claim the seniority of an identical earlier national trademark. If the protection of the national trademark then expires, it is treated as if it still existed.

In addition to the identity of the earlier mark, the registration of a seniority requires that the goods/services and the trademark owner are identical. Partial seniority is possible.

Seniority also describes the temporal relationship of different IP rights to each other. Another IP right can only be contested with a property right of earlier seniority.

The filing date, priority date, or seniority govern the determination the seniority of a registered trademark.
